TERMS AND CONDITIONS
1 PARTICIPATION
1.1 All participants must be 18 years or over. Parent guardian must be present or sign a consent form for anyone under 18 years of age.
1.2 All services purchased from The Infinity Studio Essex must be preceded by the applicant declaring any physical and/or medical limitations which may affect their ability to participate in the session/s. The participant assumes responsibility for checking their physical and/or medical limitations with their medical practitioner/s prior to participating in any of The Infinity Studio Essex sessions.
1.3 The Infinity Studio Essex is dedicated to providing sessions that match the considerations of the participant as much as possible within their chosen session/s. The participant accepts that while every effort will be made by The Infinity Studio Essex to keep all sessions safe and effective there is a risk of injury with every physical activity. The participant acknowledges that they are taking part of their own free will, and are aware of the risks by doing so. The participant agrees that neither they, their heirs, assigns nor legal representatives will sue or make any other claims of any kind whatsoever against The Infinity Studio Essex for personal injury, property loss/damage or wrongful death caused by negligence or otherwise.
1.4 Existing clients can continue into classes until 16 wks gestation after this time they will have to inform The Infinity Studio Essex and the participant takes part in these sessions at their own risk.
1.5 The Infinity Studio Essex reserves the right to refuse access to any of our sessions to any participant, if in our discretion, we consider that the health of the individual concerned may be at risk by the participants chosen session/s.
1.6 The participant agrees that the chosen session/s is non-transferable and is only for use by the participant that has signed up to their personal session/s.
1.7 The participant agrees that The Infinity Studio Essex, at its sole discretion may terminate this agreement and suspend or terminate a participants participation without refund of any payments if the participant becomes aggressive, disruptive, shows any sexual connotation toward an instructor/therapist or becomes difficult to work with.
1.8 In the case of extreme weather The Infinity Studio Essex may take the decision, in the interests of safety, to suspend sessions until further notice. The Infinity Studio Essex will make every effort to contact participants via their preferred method as soon as possible. Any sessions missed due to such circumstances will be added to the following week/s in leu of missed session/s and individual package expiry dates will be amended accordingly. No refunds will be offered in this situation.
1.9 Personal property brought to sessions is done so at the participants own risk. The Infinity Studio Essex accepts no responsibility for loss or damage sustained to such items.
1.10 Late Arrival Policy
1.10 Participants are kindly requested to arrive 5-10 minutes before the scheduled start time of their class to allow adequate time to prepare, adjust equipment (in the Reformer studio) and ensure a safe and effective warm‑up.
1.10a If a participant arrives after the class has started and the door is locked; they cannot be admitted. The session will be forfeited and a no-show fee of £15 will apply.
1.12b This policy is in place to ensure that the essential warm‑up is completed safely and to avoid disruption to other participants already engaged in the session.
2 BOOKING, FEES AND PAYMENT
2.1 The participant is responsible for full payment of fees for the selected session/s, regardless of whether you attend or complete selected session/s within the expiry date. Failure to make the agreed payments within the agreed time will result in default of the session/s. We may forward your details onto a third party to recoup the full amount due for any unpaid session/s plus any costs incurred.
2.2 All sessions are paid for in advance (unless a participant is joining on a drop in basis). Session/s times cannot be held until booked and bookings cannot be made until payment has been received.
2.3 All sessions must be paid for on a timely basis. If payment is not made on a timely basis The Infinity Studio Essex reserves the right to put those sessions on hold until payment has been received.
2.4 All sessions must be completed within the specified expiry dates that are applicable to the relevant packages purchased. These are outlined in The Infinity Studio Essex price structure and will be specified to the participant at the point of sale.
3 CLASS PACK AND INTRO OFFER EXPIRY (Infinity Reformer Pilates)
2.5 The Infinity Studio Essex applies fixed expiry dates to all Infinity Reformer class packs and introductory offers. These expiry dates apply automatically from the date of purchase. It is the responsibility of the participant to ensure that all sessions are used within the specified timeframe.
2.5a Infinity Reformer Pilates Class Packs
- A 12 Class Pack is valid for 3 months from the date of purchase.
- An 8 Class Pack is valid for 2 months from the date of purchase.
- A 4 Class Pack is valid for 1 month from the date of purchase.
2.5b All class packs are subject to strict expiry dates. Unused classes cannot be rolled over, extended, frozen, transferred, credited, or refunded once the expiry date has passed.
2.5c Infinity Reformer Pilates Intro Offer
The Intro Offer is valid for 1 month from the date of purchase. Any classes not used within this 1‑month period cannot be carried over, extended, credited, or refunded.
3. CANCELLATION AND REFUNDS
3.1 The Infinity Studio Essex requires 30 days’ notice to cancel any membership.
3.2 All rolling monthly memberships are subject to a minimum commitment period of 3 months from the start date. Cancellations cannot be processed during this initial term.
3.2a Unlimited £99 Membership (Non‑Promo Code Customers – 12‑Month Contract)
Participants who sign up for the Unlimited £99 membership without using a promotional code agree to a minimum commitment period of 12 months from the membership start date. Any participant choosing this option is fully bound by the 12‑month minimum term. This minimum term cannot be cancelled paused or reduced during the initial 12 months.
3.2b Unlimited £95 Membership (Promo Code Customers – 6‑Month Contract)
Participants who join the Unlimited £95 membership using a promotional code are subject to a minimum 6‑month contract. This minimum term cannot be cancelled or paused during the initial 6 months.
3.2c Membership Commitment Clarification
All other memberships remain subject to the standard 3‑month minimum commitment, unless otherwise stated.
3.3 Cancellation Process:
To cancel your membership, please email us at simon@theinfinitystudio.co.uk with your full name and membership details. Your cancellation will be effective 30 days from the date we receive your request, and one final payment will be required depending on your billing cycle.
3.4 Infinity Reformer Pilates: Cancellations are accepted up to 12 hours notice in advance and substitute sessions can be rescheduled (subject to availability) before the end of the expiry date of a participants individual package of session/s.
3.5 Infinity Reformer Pilates: Cancellation of Infinity Reformer Pilates classes made within 12 hours notice of the session will be forfeited and a charge of £15 will be debited from your account. No-Shows will also be charged at £15.
3.6 Infinity Gym: Cancellations are accepted up to 2 hours notice in advance and substitute sessions can be rescheduled (subject to availability) before the end of the expiry date of a participants individual package of session/s.
3.7 Infinity Gym: Cancellations Infinity Gym made within 2 hours notice of the session will be forfeited and a charge of £5 will be debited from your account. Late cancellation fee inside 2 hours is charged at £10.
3.8 Cancellations can be made via The Infinity Studio Essex booking site.
Refunds are payable under the following circumstances.
3.8a In exceptional circumstances (e.g bereaved) preventing a participant taking part or completing their session/s. The Infinity Studio Essex will determine this on a case by case basis. Additional evidence may be reasonably requested.
Refunds are not payable under the following circumstances.
3.8b Refunds are not payable for sessions that have already taken place.
3.8c A participant does not complete their sessions within the expiry date of their agreed package.
3.8d A session/s needs to be cancelled by The Infinity Studio Essex due to external conditions (severe weather etc). An alternative session will be offered (subject to availability) and the expiry date of an individuals package with be extended accordingly.
3.9 No requests for refunds shall be considered until the end of a participants package, nor where sessions within a package have been missed or elements of said package have not been completed.
3.9a Requests for refunds must be made in writing to The Infinity Studio Essex within 7 days of completion of a participants package.
3.10 Membership Pause Policy
3.10a Participants may pause their membership for up to 4 weeks per calendar year free of charge.
3.10b Any pause beyond the 4 free weeks will be charged at 50% of the participant’s usual membership fee for the duration of the pause.
3.10c A minimum of 7 days' notice is required to activate a pause. Pauses cannot be backdated.
3.10d During a pause period, participants may not make or attend bookings.
3.10e Pause periods do not stop or delay any minimum commitment term (including 3‑month, 6‑month or 12‑month contracted memberships). Minimum terms continue to run during paused periods.
4. STUDIO SESSIONS
4.1 The Infinity Studio Essex reserves the right to change the form and nature of sessions without participants prior notice. It is however the aim of The Infinity Studio to constantly improve the service to its clients.
5. DATA PROTECTION
5.1.The Infinity Studio Essex collects your personal information in the form of names, postal address, mobile phone etc which is voluntarily submitted by clients. This information is only used to fulfil clients specific requests unless permission to use it in another manor is given.
5.2. The Infinity Studio Essex website uses technology to gather information such as numbers of visitors to the site and understanding how visitors use the site.
5.3.We may share information with government and fraud prevention companies. We may do so when (a) permitted or required to do so by law; or (b) trying to protect against or prevent actual or potential fraud or unauthorised transactions; or (c) investigating fraud that has already taken place. This information is not used for marketing purposes.
6. PRIVACY, COPYRIGHT AND VIOLATIONS
6.1. The Infinity Studio Essex respects participants privacy and insists that you respect the privacy of fellow participants. By purchasing a session/s or clicking if purchasing online, this document becomes valid and you agree not to violate the publicity, privacy, confidentiality, proprietary information and rights of any participant of The Infinity Studio Essex.
6.2. Not to infringe any session/s of participants or The Infinity Studio Essex copyright.
6.3. Any confidential information shared by participants in sessions or any representative of the company is confidential and proprietary, and belongs solely and exclusively to the participant who discloses it or The Infinity Studio Essex.
6.4. All materials and information supplied to you by The Infinity Studio Essex are its confidential, proprietary and intellectual property, belonging exclusively to The Infinity Studio Essex and may not be used by you unless authorised by The Infinity Studio Essex.
6.5. The reproduction, distribution and sale of these materials and information by anyone other than The Infinity Studio Essex is strictly prohibited.
Further by purchasing any class type with The Infinity Studio Essex or clicking if purchasing online, this document becomes valid and The Infinity Studio Essex will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.
